(a) Types. — Licenses are Hunting and Fishing; each is separate.
(b) Carry. — A person engaged in hunting or fishing shall carry the applicable license and present it upon lawful request by SAPR or any peace officer.
(c) Record. — SAPR maintains the official registry of issued licenses; temporary issuance may be conducted by any peace officer acting on SAPR’s behalf.
(a) Grounds. — Material violations of this Code; unlawful take of protected species; repeated offenses; or safety-critical conduct.
(b) Sanctions. — SAPR may suspend a hunting or fishing license for up to twelve (12) months; revocation on repeated or egregious violations. Re-application timelines may be set by SAPR rule.
(c) Effect. — Suspension/revocation of a hunting license does not affect a fishing license, and vice versa.
(a) Lawful to take, year-round, within designated hunting zones: deer, boar, coyote, rabbit, and game birds (species as posted by SAPR).
(b) Possession. — Possession of parts or meat is lawful if the animal was lawfully taken under this Chapter. Possession of contraband (protected species or unlawfully taken game) is unlawful under §117.
(a) Protected. — Mountain lion (cougar) is a protected species.
(b) Self-Defense. — Lethal self-defense against a protected species is not unlawful where immediately necessary to prevent death or great bodily injury; however, harvesting or retaining any part is prohibited, and the incident shall be promptly reported to SAPR.
(c) Punishment. — Unlawful take/possession of a protected species: felony; twenty-four (24) to seventy-two (72) months; $10,000–$50,000; forfeiture of the animal remains to SAPR.
(a) Firearms. — Only Class 2 firearms may be used to take game: rifles and shotguns that are otherwise lawful to possess under PC §302 and PC §301. Handguns (Class 1) are not lawful for taking game. Class 3 weapons are prohibited.
(b) Night Hunting. — Hunting at night is permitted unless a zone posting states otherwise.
(c) Boat Hunting. — Taking game from a boat is permitted only when the vessel’s engine is off and the vessel is not under power.
(d) Prohibited Conduct. — It is unlawful to:
(1) shoot from a vehicle or aircraft;
(2) shoot from or across a public roadway;
(3) use silencers/suppressors, explosives, poison/bait toxins, or drones/UAS to locate, harass, or take wildlife;
(4) use any method otherwise unlawful under the Penal Code or Vehicle Code.
(e) Punishment. — Violations of (d): misdemeanor; one (1) to six (6) months; $1,000–$5,000. Discharging from/across a roadway may also be charged under PC §306.
(a) Rod & Line Only. — Fishing shall be by rod and line only.
(b) Limit. — No more than one (1) line per person may be used at any time.
(c) Prohibited Methods. — No explosives, poisons, chemicals, or electrical devices; no nets, traps, or snagging gear unless expressly authorized by SAPR rule.
(a) Inspection. — Upon lawful contact in the field or at access points, SAPR or any peace officer may inspect licenses, creels/coolers, and fishing gear for compliance with §131–§134.
(b) Scope. — Inspections are limited to verifying compliance with this Chapter.
(a) This Code does not preclude charging under the Penal Code or Vehicle Code where distinct elements are proven, including but not limited to:
(1) PC §301–§310 (firearms);
(2) PC §306 (unlawful discharge);
(3) VEH §217 (off-road operation) and SHC §§202–205 (work-zone safety), where applicable.
