Title I. Roadway Operations

Chapter 1. Administration & Right-of-Way

SHC §101. Definitions

  • (a) “Right-of-way” (ROW) means the public roadway, shoulder, median, sidewalk, and any area designated for public travel or traffic control.
  • (b) “Traffic control device” (TCD) means any sign, signal, marking, cone, barricade, or device placed for regulating, warning, or guiding traffic.
  • (c) “Temporary Traffic Control Plan” (TTCP) means a written or posted scheme for safe closures, tapers, detours, and controls for work, incidents, or events.
  • (d) “Work zone” means the signed/coned area where work or incident operations are conducted, including buffers and tapers.
  • (e) “Special event” means a parade, march, filming, race, festival, or other planned activity affecting normal traffic operations.

SHC §102. Jurisdiction; Emergency Closures

  • (a) Authority. — LSPD, LSCSO, BCSO, SAST, SAPR, and roadway authorities may temporarily reduce speeds, close lanes/roads, set contraflow, and post detours for safety.
  • (b) Duty to Obey. — All persons shall obey lawful closures and temporary controls posted or directed by a peace officer or authorized flagger.

SHC §103. Encroachment Permit Required

  • (a) Permit. — No person shall occupy or obstruct any portion of the ROW for work, staging, filming, or storage without an encroachment permit or an approved TTCP.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; removal of equipment.

SHC §104. Unauthorized Encroachment; Unlawful Lane Closure

  • (a) Offense. — Placing cones, signs, or barriers; or closing a lane/road without authority, permit, or TTCP is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000. If the conduct creates a substantial risk of collision: felony; twelve (12) to thirty-six (36) months.

SHC §105. Damage to Public Infrastructure; Restitution

  • (a) Offense. — Willfully or negligently damaging guardrails, signals, signs, barriers, bridges, sidewalks, or pavements is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; mandatory restitution. Felony where damage is egregious or willful.

SHC §106. Utility Work; Locate/Mark

  • (a) Offense. — Excavation or boring in ROW without utility locate/mark and a TTCP is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; restitution for damages.

Chapter 2. Work Zones & Temporary Controls

SHC §201. Establishing a Work Zone

  • (a) Requirements. — A TTCP shall define tapers, buffer space, closures, detours, device types, and worker position. Certified flaggers shall be used where sight or complexity requires.
  • (b) Hours & Lighting. — Night work requires lighting/retroreflective devices consistent with safety standards.
  • (c) Violations of this section may be charged under §§202–205.

SHC §202. Obedience to Work-Zone Devices & Flaggers

  • (a) Offense. — Disobeying work-zone TCDs or a flagger’s hand signals is unlawful.
  • (b) Punishment. — Infraction; $500–$2,500. If violation causes a collision or worker injury: misdemeanor; one (1) to six (6) months; $1,000–$5,000.

SHC §203. Work-Zone Speed; Enhanced Penalties

  • (a) Temporary Limits. — Temporary speed limits posted for a work zone are enforceable.
  • (b) Enhanced Penalties. — Fines for VEH §212 violations are doubled when workers are present and properly posted.

SHC §204. Tampering with Work-Zone Controls

  • (a) Offense. — Moving, removing, damaging, or extinguishing cones, barricades, signs, lights, or crash cushions is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; restitution. If the tampering proximately causes a collision or great bodily injury: felony; twelve (12) to thirty-six (36) months.

SHC §205. Worker Safety Buffer

  • (a) Offense. — Entering a closed lane, buffer space, or striking a traffic-management vehicle (TMA/crash truck) within a posted work zone is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; restitution. Felony where great bodily injury/death results.

Chapter 3. Special Events & Street Use

SHC §301. Special Event/Parade Permit

  • (a) Permit Required. — Parades, marches, races, festivals, or filming that affect traffic require a permit and TTCP.
  • (b) Denial/Conditions. — Agencies may condition routes/times/marshals and deny on public-safety grounds.
  • (c) Punishment. — Conducting an unpermitted event is a misdemeanor; one (1) to six (6) months; $1,000–$5,000.

SHC §302. Event Operations; Marshals; Cleanup

  • (a) Organizer Duties. — Provide marshals, barricades/TCDs per TTCP, maintain emergency access, and perform post-event cleanup.
  • (b) Failure to comply is a misdemeanor as in §301- (c); restitution for cleanup.

SHC §303. Unauthorized Street Takeovers

  • (a) Offense. — Using any roadway as a venue for unpermitted sideshows, speed contests, or exhibitions is unlawful.
  • (b) Charging Guidance. — Charge cumulatively with VEH §214 and applicable PC offenses where distinct elements are proven.

SHC §304. Immediate Suspension/Revocation

  • (a) Authority. — An event permit may be suspended or revoked at any time for imminent safety concerns or material noncompliance.
  • (b) Duty to Comply. — Organizers shall immediately comply with termination orders.

Chapter 4. Oversize/Overweight & Escorts

SHC §401. Permit for Oversize/Overweight Loads

  • (a) Offense. — Operating oversize/overweight vehicles on public roads without a permit or TTCP is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; denial of movement until compliant.

SHC §402. Escort/Pilot Car Requirements

  • (a) When Required. — Escorts/pilot cars are required when movements exceed designated thresholds or routes include constrained bridges/tunnels.
  • (b) Equipment. — Escort vehicles shall display appropriate warning devices/comms as specified in the permit.

SHC §403. Route Restrictions & Clearances

  • (a) Offense. — Operating oversize/overweight loads on prohibited routes or under clearances lower than the permitted height is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; restitution for infrastructure strikes.

SHC §404. Damage Liability

  • (a) Restitution. — Permittee and operator are jointly liable for damage to the ROW caused by an oversize/overweight movement.

SHC §405. Staging & Layover

  • (a) Prohibition. — Staging in live lanes, medians, or shoulders without authorization is unlawful.
  • (b) Punishment. — Infraction; $500–$2,500; tow/relocation as necessary.

Chapter 5. Traffic Control Devices & Access

SHC §501. Unauthorized or Fraudulent Traffic Control Devices

  • (a) Offense. — Installing, altering, or displaying any unauthorized sign, signal, or marking in the ROW; or altering official city signs/markings, is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; removal.

SHC §502. Median and Shoulder Use

  • (a) Offense. — Stopping, standing, or parking in medians or on shoulders is unlawful except in emergencies, as directed by officers, or where signage expressly permits.
  • (b) Punishment. — Infraction; $500–$2,500; towing authorized.
  • (c) Cross-References. — See VEH §238.

SHC §503. Roadside Advertising in the ROW

  • (a) Permit Required. — Temporary banners, event wayfinding, or commercial advertising placed within the ROW require a permit and TTCP.
  • (b) Prohibitions. — No device may mimic official TCDs, obscure sightlines, or distract drivers with flashing/strobing effects.
  • (c) Duration & Removal. — Permit shall specify duration; organizers must remove devices promptly after expiration.
  • (d) Punishment. — Infraction; $500–$2,500; removal. Refusal after notice: misdemeanor; one (1) to six (6) months; $1,000–$5,000.

Chapter 6. Incident Management & Towing

SHC §601. Quick-Clearance Authority (“Move It”)

  • (a) Authority. — Officers may order rapid removal of disabled vehicles, debris, or minor collision vehicles to a safe location to restore traffic.
  • (b) Good-Faith Protection. — Operators complying in good faith are not liable for ordinary damage arising from the act of clearing.

SHC §602. Rotation Tow & Scene Safety

  • (a) Rotation Tow. — Agencies may establish rotation tow lists; tow operators shall stage outside live lanes and comply with officer directions.
  • (b) Offense. — Unsafe tow operations inside buffers or disregard of officer direction is unlawful.
  • (c) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000; possible removal from rotation.

SHC §603. Abandoned Vehicles on Highways

  • (a) Removal. — Vehicles left on a highway shoulder for more than twenty-four (24) hours, or creating a hazard, may be cited and towed.
  • (b) Punishment. — Infraction; $500–$2,500; towing/storage at owner’s expense.

Chapter 7. Rail & Grade Crossings

SHC §701. Obedience at Grade Crossings

  • (a) Offense. — Drivers shall stop when warning lights are flashing, gates are lowering/lowered, a flagger signals stop, or a train is plainly visible and in hazardous proximity.
  • (b) Punishment. — Infraction; $500–$2,500. If violation causes a collision: misdemeanor; one (1) to six (6) months; $1,000–$5,000.

SHC §702. Driving Around Gates; Blocking the Crossing

  • (a) Offense. — Driving through, around, or under a lowered or lowering gate; or stopping a vehicle on the tracks or within the crossing area, is unlawful.
  • (b) Punishment. — Misdemeanor; one (1) to six (6) months; $1,000–$5,000. If collision or great bodily injury results: felony; twelve (12) to thirty-six (36) months.

SHC §703. Clearance; No Stopping on Tracks

  • (a) Duty. — A driver shall not enter a crossing unless there is sufficient space to clear the tracks without stopping.
  • (b) Punishment. — Infraction; $500–$2,500.

SHC §704. Disabled Vehicle on Tracks; Immediate Notice

  • (a) Duty. — A driver whose vehicle becomes disabled on the tracks shall immediately evacuate occupants to a place of safety and contact emergency services.
  • (b) Punishment. — Infraction; $500–$2,500. Failure resulting in collision may be charged under §§701–702 or applicable PC/VEH provisions.
